Question:

I was recently in a car accident which there was no insurance. The insurance company has charged me with the cost of $28,000...I also received driving offense tickets on this same incident. If I file bankruptcy will it remove the insurance claim...there are other outstanding debts which have gone to collection

Answer:

When you are uninsured there is a fund that pays out the costs on your behalf and technically the debt is dischargeable in a bankruptcy however, your driver's license will be suspended unless you pay. If you can live without a driver's license (most people can't), then a bankruptcy would work but if you need to drive, you should make an arrangement with the Uninsured motorist fund and consider it to be the cost of having the privilege to drive.
